Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Excise P.S. Case No. 389 of 2023 bearing Special Case No. 2598 of 2023 registered for the offences under Section 30(a) & 56(b) of the Bihar Prohibition and Excise Act, 2016 & Amended Act, 2022.

Learned counsel for the petitioner submits that the petitioner is in custody since 10.03.2023 and it is alleged that there is recovery of 80 liters of illicit Chulai liquor. The petitioner has two criminal antecedents.

Patna High Court CR. MISC. No.33890 of 2023(2) dt.23-05-2023 2/2 Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody and the allegations levelled against the petitioner, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of ₹10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the learned Court of Special Judge Excise, Patna in connection with Excise Patna P.S. Case No. 389 of 2023 bearing Special Case No. 2598 of 2023.

The petitioner will visit Masaurhi Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
