The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 309/313/498A/34 of the Indian Penal Code. Later on, offences under Sections 324/326/304B of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act were added. The FIR would reveal that due to torture of the husband the informant attempted to commit suicide by burning herself and subsequently died. Husband is already in custody. Petitioner is mother-in-law of the deceased. There is no allegation against the petitioner.
Considering the aforesaid fact, let the petitioner, above named, in the event of her arrest or surrender before the
Patna High Court Cr.Misc. No.76677 of 2018(2) dt.21-12-2018 2/2 Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court-below where the case is pending in connection with Nayagaon Police Station Case No.24 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
