JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-03-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 475 of 2017 in which cognizance has been taken under Sections 498A and 504 of the Indian Penal Code.

Allegation against the petitioner is of subjecting the complainant to cruelty and harassment with respect to demand of Rs. 2 lakh as dowry.

Submission of learned counsel for the petitioner is that earlier a case has been lodged under Section 498A IPC and on compromise petitioner has been granted bail and again the present case has been filed he is still ready to keep her with him. On the other hand, learned counsel for the complainant has submitted that she is also ready to live with the petitioner and after compromise she was ousted from the house of the petitioner.

No.79067 of 2018(3) dt.07-03-2019 2/2 Having heard both sides and in the facts and circumstances, let petitioner, above named, surrender in the court below on 1.4.2019 and on that day he will file a petition that he is ready to keep the complainant with him and the complainant shall also be present in court on that day and if the court below finds that petitioner is ready to keep the complainant with him, he will be released on provisional bail for a period of six months on the condition that both petitioner and complainant will appear in court in first week of every month and the court below shall watch their conduct and once the court below is satisfied with the conduct of both parties, the bail bond of the petitioner shall be confirmed by the court below, otherwise the court below is free to pass any other order(s) as it may deem fit and proper.

With the above observation, this application is disposed of.
