The petitioner is apprehending his arrest in connection with Ayar P.S.Case No.48 of 2018 registered for offences punishable under Sections 302/34 of the Indian Penal Code. Allegation against the petitioner and other two accused persons is of assault by lathi and iron rod on head causing injury to the father of the informant, who succumbed to the injuries later on.

Submission of the learned counsel for the petitioner is that thee is case and counter case and the petitioner has also received injuries.

Heard learned A.P.P. also.

Having heard both sides and in view of allegation of

Patna High Court Cr.Misc. No.76512 of 2018(2) dt.31-01-2019 2/2 assault against the petitioner also, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court. With the aforesaid observation, this application is dismissed.
