JUSTICE GOPAL PRASAD ORAL ORDER 16-03-2016 Heard learned counsel for the petitioner and the State. A report has been called for in which it has been reported that in this case charge has been framed on 23.7.2015 against the petitioner and only two witnesses have been examined and ten prosecution witnesses are yet to be examined. The prayer for bail on behalf of the petitioner was earlier rejected vide order dated 31.03.2014 passed in Cr. Misc. No. 37894 of 2013.

Learned counsel for the petitioner submits that the petitioner is in jail custody since 29.01.2013 but the case is not proceeded.

Hence, the trial court is directed to take all coercive steps against the witnesses and the process against the witnesses be issued through the Superintendent of Police, Rohtas at Sasaram

Patna High Court Cr.Misc. No.44245 of 2014 (3) dt.16-03-2016 2/2 and the Superintendent of Police, Rohtas at Sasaram is directed to ensure attendance of the witnesses on the date fixed and the trial be proceeded on day-to-day basis for early disposal of the case. It may be taken note of that non-compliance of the order may have serious consequence and the witnesses must be produced on the date fixed so that all the ten witnesses be exhausted within 6 months.

With these observations, this petition is disposed of with liberty to the petitioner that if the witnesses are not exhausted within six months then he may renew his prayer for bail. (Gopal Prasad, J) siddharth/- U T
