When the case is called out no one appeared for the petitioners, however, learned counsel for the State is present. A counter affidavit has been filed in this case on behalf of respondent no 4 in which it is stated that in course of investigation the case has been found to be true. None of the accused in the case is on bail and therefore, the whole intention of the accused is to delay the disposal of the case. In the daily cause list of this Court a general notice has been published
Patna High Court Cr. WJC No.1128 of 2015(5) dt.01-08-2018 2/2 requesting the learned counsel for the petitioner and the State to come prepared in old cases with information as to the present position of the investigation and proceeding before the court below. Despite the notice learned counsel for the petitioners is not putting appearance with the instructions, this Court has reasons to believe that the petitioners are not interested in pursuing the matter.
This writ application is, therefore dismissed as not pressed.
