This application for grant of regular bail arises out of Chakmehsi P.S. Case No. 36 of 2018 registered for the offence punishable under Sections 147, 148, 149, 302, 307, 323, 325, 341, 447 and 504 of the Indian Penal Code.
There are seventeen persons, who have been named in the F.I.R. Most of the male and female members of the petitioner's family have been implicated. It is evident that dispute in relation to immovable property, is in the background of the alleged occurrence.
Learned counsel for the petitioner has drawn my attention to an order of this Court dated 01.11.2020, passed in Cr. Misc. No. 58635 of 2018 and Cr. Misc. No. 60928 of 2018
Patna High Court CR. MISC. No.31614 of 2020(2) dt.03-12-2020 2/2 to submit that similarly circumstanced co-accused persons have been allowed regular bail by this Court. The petitioner is in custody since 05.05.2020.
Considering the facts and circumstances, as noted above, this application is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Samastipur in connection with Chakmehsi P.S. Case No. 36 of 2018.
