JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-04-2023 The District Magistrate, Bhojpur at Ara is present in the Court and has filed a counter affidavit, wherein it has been stated that the entire encroachments in question have been removed. It is also submitted that in the district of Bhojpur, 112 encroachment cases are pending and expeditious steps are being taken to conclude the proceedings of the said encroachment cases.
This Court is satisfied with the report, submitted by the District Magistrate, Bhojpur at Ara, hence, the Rule is discharged.
In view of the aforesaid, the second case has become infructuous, hence, is dismissed.
As far as the first case is concerned, the learned counsel for the petitioners seeks liberty on behalf of the petitioners to avail such other alternative remedies as are otherwise available under the law. Liberty, so sought, is granted. Accordingly, the first writ petition stands disposed off
