The petitioner seeks bail in Buxar (T) P.S. Case No. 281 of 2019, instituted for the offence under Section(s) 30(a) of Bihar Excise (Amendment) Act, 2018.

It is alleged in the written report that total 8.640 litres of foreign liquor has been recovered from the Tempo kept beneath the seat of the petitioner.

Counsel for the petitioner submits that petitioner is driver of the Tempo. He had no knowledge about the passenger who was carrying wine in the aforesaid Tempo. Petitioner is in custody since 29.3.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of

Patna High Court CR. MISC. No.30951 of 2019(2) dt.29-05-2019 2/2 the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. II cum Special Judge, Excise Act, Buxar, in connection with Buxar (T) P.S. Case No. 281 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioner.
