Learned counsel for the petitioner has submitted that the petitioner is plaintiff before the court below in Title Suit No. 190 of 2009. She has filed a petition for interim injunction under

Patna High Court C.Misc. No.325 of 2021(2) dt.30-11-2021 2/2 Order 39, Rules 1 and 2 of the Civil Procedure Code (hereinafter to be referred to as 'the Code') on 20.09.2016, but still that petition has not been disposed of after a lapse of near about five years.

In view of aforesaid, the learned court below is directed to dispose of the petition filed on behalf of the petitioner/plaintiff under Order 39, Rules 1 and 2 of the Code within a period of three months, if it has not already been disposed of.

With this direction/observation, this civil miscellaneous application is disposed of.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court.
