Petitioner is in custody in connection with Mahkar P.S.Case No.67 of 2016 registered for an offence under Section 395 of the Indian Penal Code.

The FIR of the occurrence of dacoity is against unknown person.

It is submitted on behalf of the petitioner that there is no recovery from the possession of the petitioner nor he was ever put on test identification parade during course of investigation. It is also submitted that chargesheet has already been submitted and petitioner is in custody since 09.01.2019 and similarly situated co-accused persons have already been granted bail by coordinate Benches of this Court in

Patna High Court CR. MISC. No.36918 of 2019(3) dt.04-09-2019 2/2 Cr.Misc.No.2443 of 2018 and Cr.Misc.No.44376 of 2018. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Gaya in connection with Mahkar P.S.Case No.67 of 2016.
