Informant who happens to be owner of a Bolero Jeep bearing Registration No. BR-03P-7611 which runs as a taxi, was taken on hire on 09.09.2013 as disclosed by his driver, Shetty Chaudhary to and fro to Balia Manjhi by four persons. He had further disclosed that the driver had intimated him that he will return back by the late night. As the driver did not return, he began to search and during course thereof, had found his vehicle at village-Baheri Balia having number plate replaced and on account thereof, he informed the police and they took away the vehicle to Kotwali PS.
From perusal of the case diary, it is apparent from para-28 that three motorcycle ridden persons were found in
Patna High Court Cr.Misc. No.43034 of 2014 (3) dt.03-04-2015 suspicious activities, were intercepted, searched and from their possession unauthorized arms were recovered. During course of interrogation, one of the culprits had confessed his guilt including his associates under inculpatory extra judicial confessional statement whereunder identified the petitioner to be assailant of deceased, the driver and further slipping with the vehicle which, unfortunately, got apprehended during course of continuance of replacement/modification process. It is also apparent that the dead body of deceased had also been found. It is further evident from the case diary that save and except the aforesaid material, nothing more has been collected.
It is further evident that the person who had made inculpatory extra judicial confessional statement had already been granted bail vide Cr.Misc.No.37919/2014. Accordingly, Golu Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Ara, Bhojpur in connection with Rail Thana Buxar PS. Case No. 28/2013.
