The petitioner is in custody since 8.9.2014 in connection with Runnisaidpur P.S. Case No.319 of 2014.
The allegation against the petitioner is that the informant recovered 17 children from a Government bus and as a defence they stated that they were being taken for education at Madarsa in Pune by the petitioner and the accused persons were working as teachers of embroidery at Pune. The petitioner also could not produce any paper regarding information of taking the children from one State to another, which is a requirement under law. It was in this premise, the petitioner was arrested. Learned counsel for the petitioner submits that after
Patna High Court Cr.Misc. No.46681 of 2014 (2) dt.16-02-2015 2/2 investigation of the case, the said case has been found to be untrue for want of adequate evidence.
Considering the aforementioned submissions and the period of custody and also the fact that the parents/guardians of the children, who were so recovered along with the petitioner, have given affidavits that their children had gone with their consent, let the above named petitioner be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi, in connection with Runnisaidpur P.S. Case No.319 of 2014.
