The petitioner seeks bail in a case registered under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that the petitioner fired, which hit upon the forehead of son of the informant, due to which he fell down and he was taken to the Hospital for treatment and during treatment his son died.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 04.12.2018. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. From perusal of the F.I.R., it appears that the petitioner has falsely been implicated

Patna High Court CR. MISC. No.30665 of 2019(3) dt.20-09-2019 2/2 in the present case. On the occasion of marriage celebration, a firing was made by the petitioner, which hit the deceased. Admittedly there was no intention to commit murder. It was accidental death. At best, it is a case for an offence under Section 304 I.P.C. No repetition is said to have been made. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai in connection with Bhagwanpur P.S. case No.241 of 2018.
