JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-12-2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Mohammadpur P. S. case no. 202/2018 registered under sections 30(a), 38 and 41 of Bihar Prohibition and Excise Act. It is alleged that when the informant and other police officials went near the house of the petitioner, petitioner managed to escape from there leaving behind his motorcycle. Motorcycle of the petitioner was searched and 96 bottles Indian made foreign liquor were recovered from a bag which had been tagged with the aforesaid motorcycle and similarly, in huge quantity Indian made foreign liquors were recovered behind the house of the petitioner.

No.76727 of 2018(2) dt.21-12-2018 2/2 Accordingly, it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge II-cum- Special Judge, Excise, Gopalganj in Mohammadpur P. S. case no. 202/2018 subject to condition as laid down under section 438(2) of the Cr.P.C.
