2. Learned counsel for the petitioners, after some arguments, submits that he seeks permission to withdraw the present bail application.

3. He further submits that regular bail was granted to the petitioner. However, cognizance was taken under a nonbailable offence, and the petitioner could not appear on the first date of hearing. Due to this, his bail bond was cancelled. The petitioner then moved for anticipatory bail before the Sessions Court, which rejected the application as not maintainable. Here again, he has moved for anticipatory bail.

4. Learned counsel for the State submits that the actual remedy available to the petitioner against the cancellation of the bail bond is by way of appeal under Section 409 of the Cr.P.C. Now, the corresponding provision is under Section 449 of the BNSS.

5. Accordingly, the present bail application stands dismissed as withdrawn.
