The petitioner is apprehending his arrest in connection with Amnaur P.S.Case No.142 of 2018 , registered for offences punishable under Sections 304(B), 201, 34 of the Indian Penal Code.

Allegation against the petitioner, who happens to be mother-in-law of setting ablaze the deceased. Submission of the learned counsel for the petitioner is that she is aged about 60 years old, suffering from some diseases and no specific allegation has been attributed against her and as a matter of fact during preparation of food, her Saari caught fire, she was taken to the Hajipur Hospital by her husband and other family members and from there she was referred to PMCH and during the course of treatment she died

Patna High Court CR. MISC. No.77118 of 2018(3) dt.12-04-2019 2/2 and thereafter the dead boy was disposed of in presence of the family members of the informant and now the false and concocted case has been lodged.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-II, Chapra in connection with Amnaur P.S.Case No.142 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid observation, this application is allowed.
