JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 03-03-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered in connection with Saharghat P.S.Case No. 194 of 2018 for the offences punishable under Sections 272, 273,of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act .
As per allegation in the F.I.R 135 liters Nepali liquor was recovered from Indica Car. One co-accused fled away and the other was caught by the police.
Learned counsel for the petitioner submits that petitioner is falsely implicated in this case. Petitioner was not caught on the spot. Petitioner has no concerned with the said liquor and the said vehicle was belongs to Ajay Kumar Jha.
Patna High Court CR. MISC. No.42538 of 2021(2) dt.03-03-2022 2/2 Learned Additional Public Prosecutor opposed the bail prayer of the petitioner.
Considering the facts and circumstance of the case as well as submission of the parties, let the petitioner in the event of his arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II ,cum Special Judge Excise Act, Madhubani in connection with Saharghat P.S Case No. 194 of 2018 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
