The victim is a minor girl. Laws are rather rigid and strict about protecting minors against sexual offence. Even according to the medical report, the victim girl is not over the age of 17 years. Allurement of marriage is said to be the reason for her exploitation by the petitioner, who himself is not minor, but is stated to be about 22 years.

The society cannot survive if the person like the petitioner is enlarged on bail with the kind of allegation made. However, if the parties reconciliate their differences and overcome the stigma of the family of the victim girl, that is another issue, for which petitioner may thereafter approach the Court for appropriate direction.
