The petitioner seeks regular bail in connection with Barauli P.S. Case No. 42 of 2023, registered for the offences punishable under Section 392 of the Indian Penal Code. As per the prosecution case, it is alleged that all the accused persons including this petitioner on the point of knife took ATM card from the informant and by getting ATM PIN Number, they withdrawn Rs. 15,600/- and took Rs. 1500/- cash from the pocket of the informant and they also snatched mobiles from the informant and his friend, Manish Kumar. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and except the confessional statement there is no evidence against the

The petitioner has not been put on Test Identification Parade and no looted articles have been recovered from the possession of the petitioner. Petitioner has three criminal antecedent in which he is on bail. Petitioner is in jail custody since 31.01.2023. The charge-sheet has already been filed against the petitioner and there is no chance of absconding of the petitioner.
Learned APP for the State has opposed the prayer for regular bail of the petitioner.
Considering the facts and circumstances of the case let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate First Class, Gopalganj in connection with Barauli P.S. Case No. 42 of 2023, subject to the following conditions:- (i) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court. (ii) In case of absence on two consecutive dates without sufficient reason or if the petitioner misuse the liberty or violate any of the conditions imposed upon him his bail bond
Patna High Court CR. MISC. No.33910 of 2023(2) dt.24-06-2023 3/3 will be liable to be cancelled by the Court concerned. (iii) If the petitioner tampers with the evidence or the witness, in that case the prosecution will be at liberty to move for cancellation of bail.
