The petitioner seeks bail in a case under Section 302 of the Indian Penal Code.

The petitioner is the husband of the deceased. Prayer for bail of the petitioner was earlier rejected vide order dated 04.03.2014 passed in Cr. Misc. No. 589/14.

The dead body of the deceased, the wife of the petitioner, was found inside the house and the door was locked. It is submitted that the informant is not an eye witness of the occurrence and he got only information that the petitioner killed his wife and fled away with his children after locking the door. There is a strong circumstance against the petitioner as the house of the petitioner was found locked from outside and the dead body of his wife was found inside the house. Hence, I am

Patna High Court Cr.Misc. No.4042 of 2015 (3) dt.20-03-2015 2/2 not inclined to enlarge the petitioner on bail in Chowk P.S. Case No. 57/2013. Accordingly, the same is rejected. The trial court is directed to expedite the trial and conclude the same within nine months from the date of receipt / production of this order.

If the trial is not concluded within the above stipulated period of time, the petitioner may renew his prayer for bail firstly in the trial court itself.
