JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 08-12-2020 Learned counsel for the petitioner undertakes to remove all the defects as pointed out by office within four weeks after start of normal functioning of the Court. Heard learned counsel for the petitioner and Mr. Shailendra Kumar Singh, learned A.P.P. for the State. Petitioner in the present case is seeking regular bail in connection with Muffasil P.S. Case No. 622 of 2018 registered for the offence under Section 392 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Learned counsel submits that the name of the petitioner has transpired in the confessional statement of the co-accused from whose possession the looted mobile has been recovered. The petitioner is in jail since 22.02.2020.

Learned A.P.P. for the State has opposed the prayer for

Patna High Court CR. MISC. No.32595 of 2020(2) dt.08-12-2020 2/2 regular bail of the petitioner.

Having regard to the facts and circumstances of the case, wherein the name of the petitioner has transpired in the confessional statement of the co-accused from whose possession the looted mobile has been recovered and it has come from the details of CDR of the looted mobile and the I.O. came to know in course of investigation that the petitioner had given the looted mobile to co-accused Ashutosh Kumar and then the petitioner has also confessed his guilt and has narrated the manner of occurrence as also considering that the petitioner has got huge criminal antecedent of similar nature and he has been involved in committing offences while on bail in other cases, this Court is not inclined to grant regular bail to the petitioner. The prayer for regular bail of the petitioner is, thus, refused.

Let the trial be expedited.
