This application has been filed for modification of the order, dated 06.11.2019, passed in Criminal Misc. No. 28851 of 2019, whereby the present petitioner has been granted privilege of anticipatory bail subject to the condition that the petitioner shall surrender before the learned Court below within a period of ten weeks from the date of the order.
Learned Counsel for the petitioner submits that pursuant to the order, dated 06.11.2019, the petitioner has deposited bank draft of Rs. 1,00,000/- prepared in the name of
Patna High Court CR. MISC. No.7441 of 2021(2) dt.03-02-2021 2/2 O. P. No. 2 in the Court below itself, which has been received by the O. P. No. 2 under acknowledge/receipt, which wold be evident from Annexure-2 to this application. He referring to paragraph 9 of this application, submits that the rest amount of Rs. 1,00,000/- has been deposited in the bank account of O. P. No. 2 and in support of the same, he has annexed bank deposit slip (Annexure-6). He further submits that due to inadvertence, the said amount of Rs. 1,00,000/- could not be deposited within the stipulated time. He accordingly prays for three weeks' more time to surrender before the learned Court below. Having regard to the submissions made on behalf of the petitioner, let the time granted by this Court to surrender before the learned Court below by order, dated 06.11.2019, passed in Criminal Misc. No. 28851 of 2019, is hereby extended by further two weeks from today.
Accordingly, this application is allowed to the extent indicated above.
