JUSTICE MOHIT KUMAR SHAH) 27-08-2025 We find that a letter dated 18.07.2025 has been sent to this Court by the Superintendent of Police, Bhojpur at Ara wherein it has been stated that the sole appellant of the present appeal, namely Lallan Yadav, S/o Jago Yadav has already died and in support thereof a report of the Inspector of Police-cumOfficer In-Charge, Bihiya Police Station dated 18.07.2025 has been annexed wherein he has stated that the Ward Parshad of Ward No. 14, Nagar Panchayat, Bihiya has given a certificate on her letter pad, certifying that the aforesaid appellant has died. We also find that a death certificate dated 28.12.2022, issued by the Registrar (Birth & Death), Nagar Panchayat Bihiya has been brought on record, which shows that the death of the appellant took place on 27.11.2022, nonetheless we find that there is some

Patna High Court CR. APP (DB) No.367 of 2001(5) dt.27-08-2025 2/2 discrepancy in the name of the aforesaid appellant which has been written as Lalan Singh instead of Lallan Yadav as also in the name of his father which has been mentioned as Jagadev Yadav instead of Jago Yadav.

Thus, taking a holistic view of the matter and considering the letter of the Superintendent of Police, Bhojpur at Ara dated 18.07.2025, the report of the Inspector of Police-cumOfficer In-Charge, Bihiya Police Station dated 18.07.2025 supported by certificate issued by the Ward Parshad and the death certificate of the appellant dated 28.12.2022, we are of the view that the factum of the death of the aforesaid appellant, namely Lallan Yadav is not in dispute, hence the present appeal stands abated.

3. Let the records of the aforesaid appeal be consigned to the record room.
