The petitioners who are said to have been working on the post of Instructor and Laboratory Assistant in the MIT Muzaffarpur on contractual basis, have approached this Court seeking a direction upon the concerned respondents to consider their cases for regularization/ absorption against the sanctioned and vacant post of Laboratory Assistant and Instructor, with all consequential benefits.

Learned Advocate for the petitioners submitted that the petitioners were initially engaged on a contractual basis in the year 2008 and have continuously been discharging their duties pursuant to orders issued by the competent authorities from time to time. However, despite the continued requirement

3/4 of their services at MIT, Muzaffarpur and notwithstanding the petitioners having sufficient and required eligibility, their claim for regularization has not yet been considered by the authorities concerned. For redressal of their grievance, the petitioners have also submitted representation before the Director-cum-Special Secretary, Science, Technology and Technical Education Department, Government of Bihar, who is stated to be the competent authority in the matter.

Learned Advocate for the State, on the other hand, submitted that the initial engagement of the petitioners appears to have been purely contractual in nature and made at the discretion of the Principal of the college. It is, therefore, contended that the petitioners may not have any enforceable right to claim regularization.

5. Having considered the limited grievance of the petitioners that their claim for regularization has not yet been examined by the competent authority, this Court, without expressing any opinion on the merits of the claim, deems it fit and proper to dispose of the writ petition with liberty to the petitioners to file a fresh representation before the Directorcum-Special Secretary, Science, Technology and Technical Education Department, Government of Bihar, within a period of

4/4 four weeks from today.

6. In the event such a representation is filed within the aforesaid period, the competent authority shall consider and dispose of the same by a reasoned and speaking order, in accordance with law, preferably within a further period of eight weeks from the date of receipt/production of a copy of this order.

7. The writ petition stands disposed of.
