The petitioner apprehends his arrest in Barbigha PS Case No. 13 of 2022 registered for the offences punishable under Section 379 of the Indian Penal Code.

As per the prosecution case, informant suspects that this petitioner has committed theft of his motorcycle. It is submitted that informant is not eye-witness of the occurrence and has been made accused in this case only on suspicion. No stolen article has been recovered from his possession.

Counsel for State however, vehemently opposed the prayer for bail and submitted that petitioner is named in the FIR and has got criminal antecedent of similar nature. Considering the facts aforesaid and criminal
