The petitioner seeks bail in Tisiauta P.S. Case No. 47 of 2014, registered for the offences punishable under Section 392 of the Indian Penal Code.

The present case is lodged against four unknown persons for committing robbery of a truck bearing Registration No. HR-38M-8682 with loaded TMT iron rod of Jaibir TMT. Learned counsel for the petitioner submits that the petitioner along with other accused persons was arrested with the truck bearing Registration No. HR-55P-1043 and for that Tisiauta P.S. Case No. 49 of 2014 was registered. The petitioner and other accused persons are said to have confessed their guilt disclosed that they have looted the truck bearing Registration No. HR-38M8682 and on the basis of the aforesaid confessional statement the

Patna High Court Cr.Misc. No.4597 of 2015 (3) dt.25-03-2015 2/2 petitioner is made accused in the present case. Nothing has been recovered nor the petitioner was put on test identification parade. The petitioner is in jail since 12.09.2014.

Considering the facts aforesaid and the fact that the investigation officer did not collect any tangible evidence to show the involvement of the petitioner in the present case, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Tisiauta P.S. Case No. 47 of 2014.
