The petitioners are apprehending their arrest in a complaint case in which processes gave been directed to be issued after cognizance being taken for the offences punishable under Sections 323, 341, 420/34 of the Indian Penal Code. It is alleged that the petitioners had executed the land in favour of nephew of the informant after receiving the money. Subsequently they were found that the sale deed was executed by the petitioner in favour of the son of petitioner no.1. It is submitted by the learned counsel for the petitioner that the entire area of land is 39 decimals, out of which
Patna High Court Cr.Misc. No.7235 of 2015 (2) dt.23-02-2015 2/2 he sold 6 decimals land to his wife and he also sold 8 decimals land to the nephew of the complainant. There is dispute between the parties and a Title Suit No. 155/05 is pending. Considering the above facts , let the above named petitioners be released on anticipatory bail , in the event of arrear or surrender before the learned court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Araria in connection with Complaint Case No. 29-C of 2010, subject to the conditions as laid down u/s 438(2) Cr.P.C.
