The petitioner has prayed for grant of regular bail in a case registered under sections 420, 401, 402, 413, 414, 467, 468, 471 and 379 of the Indian Penal Code.

As per the prosecution case, on the vehicle of the petitioner and others being stopped and searched it is stated that various registration number plates of vehicles, mobile phones and other articles as mentioned in the F.I.R were recovered and the accused persons including the petitioner disclosed that they commit theft etc.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. The petitioner is in custody since 13.3.2022 and charge-sheet

Heard learned A.P.P for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the petitioner being in custody for 10 months since 13.3.2022 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Kotwa P.S. Case no. 86 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran.
