JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2019 At the very outset, learned counsel for the petitioners seeks permission to withdraw this application with respect to petitioner No.4, Ranjit Yadav stating that he has been arrested during pendency of this application.
This application as against petitioner No.4 Ranjit Yadav is dismissed as withdrawn.
Petitioners apprehend their arrest in connection with Hisua P.S. Case No. 287 of 2018 registered for the offences punishable under Sections 147, 148, 341, 323, 504, 427 and 307 of the Indian Penal Code, including Section 27 of the Arms Act. Allegation against the petitioners is of assault to the informant and others and there is specific allegation of assault
Patna High Court Cr.Misc. No.1158 of 2019(2) dt.17-01-2019 2/2 against one Subodh Yadav by rod.
Submission of learned counsel for the petitioners is that the injuries are simple in nature except one for which opinion was reserved and there is case and counter case between the parties.

Having heard both sides and in the facts and circumstances, let petitioners, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Hisua P.S. Case No. 287 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
