JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2019 This is an application for grant of anticipatory bail in connection with Barabar Prayatak (Bishunganj O.P.) P.S. Case No. 92 of 2018, disclosing offences under Sections 302/34 of the Indian Penal Code.

Allegation as per F.I.R. is that the petitioners and other accused persons came on the roof and assaulted the deceased due to which he succumbed to the injury. Submission of learned counsel for the petitioners is that the deceased was a mentally insane person and at the instances of the villagers, the petitioners have falsely been implicated in this case. Further, they have no criminal antecedents.

Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Jehanabad, in connection with Barabar Prayatak (Bishunganj O.P.) P.S. Case No. 92 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
