Case No.123 of 2013, for the offence punishable under Sections-307, 448, 323, 324, 325, 379 and 504/34 of I.P.C. He was arrested on 13.8.2014. B.P. No.2219 of 2014, filed by him in the court of 1st Additional Sessions Judge, Samastipur was dismissed on 22.9.2014. Hence, this application for regular bail.

Heard learned counsel for the petitioner and learned A.P.P. for the State.

Learned P.P. has filed the case diary and on perusal of the same as well as the fardbeyan, this Court, prima facie, finds that the complainant figured as an accused in a case registered at the instance of the wife of

Patna High Court Cr.Misc. No.43250 of 2014 (3) dt.03-03-2015 2/2 the petitioner. The plea of the petitioner that the present case has been instituted only as a counter blast cannot be ignored. Further, though the case is one under Section 307 of I.P.C., till today the injury report has not been obtained. This court is of the view that the petitioner deserves to be granted bail. Hence, the petition is allowed. The petitioner is directed to be released on bail upon furnishing the bail-bonds of Rs.10,000/- (ten thousand) along with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Rosera in Samastipur District, in connection with Bibhutipur P.S. Case No123 of 2013.
