JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-09-2020 This is an application seeking quashing of the F.I.R. bearing Dariyapur P. S. Case No. 64 of 2016 dated 10.03.2016 instituted for the offences under Sections 420/120(B)/201 of the Indian Penal Code and Section 13(2) of the Prevention of Corruption Act, 1988. Mr. Md. Aslam Ansari, learned APP for the State has submitted that this is a case of the year 2016

Patna High Court CR. MISC. No.35720 of 2016(3) dt.17-09-2020 2/2 and the investigation in this case must have been completed by now.

There is no material on record to indicate that the investigation has continued up till now. In all its probability, the investigation would have been completed by now.

If at all the investigation is pending, the Investigating Officer is directed to conclude the investigation, preferably within a period of three months from the date of receipt/production of a copy of this order.

The aforesaid direction shall be implemented only if the case has remained pending at the stage of investigation.

With the aforesaid observation / direction, this petition stands disposed off.
