JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-03-2021 As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office, within four weeks of starting of the Court proceeding in physical mode in normal course.

Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends her arrest in connection with Maharajganj P.S. Case No. 16 of 2020, registered under Sections 341, 323, 324, 307, 452, 379 nd 504/34 of the Indian Penal Code.

The accusation is that Sonia Devi and her husband, Bhola Driver, neighbour of the informant, Anand Prasad Singh, threw the garbage over the land of the informant in the morning

Patna High Court CR. MISC. No.33477 of 2020(2) dt.16-03-2021 2/3 of 18.01.2020 then he made protest, on which, Sonia Devi took sward from her house and gave sward blow causing injury at his head. In the meantime, Ram Prasad Singh and Rina Devi, father and wife of the informant, reached there to save him then Nittu Kumar Prasad and Yashwant Kumar Prasad, both brothers of Sonia Devi and Arjun Prasad having armed with sward and farsa came there and Nittu Prasad gave sward blow at the head of his father, Ram Prasad Singh. When the informant fled away in his house then all entered in his house and started to cause assault. At that time, petitioner snatched the gold chain from the neck of his wife.

Learned counsel for the petitioner submits that due to land dispute, occurrence took place, in which, it is alleged that petitioner gave sward blow at the head of the informant but all the injuries found on the persons of the informant are simple in nature, except injury no. 4, which is cut wound on right ring finger and little finger of the right side, caused by hard and blunt substance. Further submission is that petitioner, who is lady, has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of her arrest or surrender before the learned Court below

No.33477 of 2020(2) dt.16-03-2021 3/3 within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-V, Siwan, in connection with Maharajganj P.S. Case No. 16 of 2020, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
