JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-03-2019 Petitioner seeks bail in anticipation of his arrest in connection with Charpokhari P.S. Case No. 129 of 2013, registered for the offence punishable under Section 304 of the Indian Penal Code.

Allegation as per FIR is that the deceased was working under the petitioner in road construction work and the informant received mobile call that dead body of the deceased was kept at Ara hospital and then he went there and saw the dead body and he believed that deceased died due to assault. Submission of learned counsel for the petitioner is that the witnesses in paragraphs 7 and 10 of the case diary disclosed that the deceased fell ill and he was taken to hospital for treatment and on way he died and the Doctor who has treated the deceased has not supported the prosecution case and

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-X, Bhojpur at Ara, in connection with Charpokhari P.S. Case No. 129 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
