JUSTICE SATYAVRAT VERMA ORAL ORDER 28-11-2022 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned Spl. P.P. for the Vigilance. The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is a woman with clean antecedent and the informant alleges that petitioner secured appointment as Panchayat teacher based on forged mark-sheet of BETET.
Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is next submitted that the entire inquiry was held behind her back
Patna High Court CR. MISC. No.33840 of 2022(2) dt.28-11-2022 2/2 and had an opportunity been given to the petitioner to explain her side of the case, perhaps the present FIR would not have been instituted.
Learned Spl. P.P. for the Vigilance opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Rajgir P.S. Case No. 182 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
