The petitioner apprehends his arrest in connection with Dhaka P.S. Case No. 302 of 2024 instituted for the offences under Sections 191(2), 191(3), 190, 329(4), 324(4), 326(g), 115(2), 109, 132, 221, 121(1), 121(2) of the Bharatiya Nyaya Sanhita, 2023.

Prosecution case, in short, is that the accused persons enraged after a person was declared dead at the hospital, and they allegedly assaulted medical staff and set an ambulance
Patna High Court CR. MISC. No.31799 of 2025(3) dt.27-06-2025 2/3 on fire. Later on, their identification was established through video footage.

Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Petitioner is not named in the F.I.R. The name of the petitioner transpired during investigation in this case on the basis of suspicion at the instance of his local rivals. No specific overt act is alleged against the petitioner. It has been submitted on behalf of the petitioner that the petitioner has no criminal antecedent. The co-accused person has already been granted regular bail by this Court vide order dated 01-05-2025 passed in Cr. Misc. No. 29807 of 2025.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 6.
Considering the rival submissions made by the learned counsel for the parties, let the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Dhaka P.S.
Patna High Court CR. MISC. No.31799 of 2025(3) dt.27-06-2025 3/3 Case No. 302 of 2024, subject to the conditions as laid down under Section 482(2) of the BNSS, 2023.
