This application for anticipatory bail arises out of Kochas P.S. Case No. 205 of 2018 for the offence under Sections 147, 148, 149, 341, 323 and 448 of the Indian Penal Code and Section 27 of the Arms Act.

There is allegation against the persons, named in the First Information Report, that armed with lathi and gun, they entered into informant's house and they were trying to take away certain articles. On protest, co-accused Sipahi Singh is said to have assaulted her and petitioners No. 1 and 2 opened fire causing injuries in the hands of the informant's father-inlaw. Injury report has been brought on record by way of

Patna High Court CR. MISC. No.30620 of 2019(2) dt.09-05-2019 2/2 Annexure-2, from which, it appears that the informant's fatherin-law sustained bullet injuries. In such view of the matter, case for anticipatory bail is not made out. This application is accordingly rejected. The petitioners are directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If they do so, their application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
