The petitioner, namely, Alok Singh @ Samresh Singh, who is in custody since 01.09.2014 in connection with Mahnar P.S. Case No.122 of 2014 under Section 302, 201 and 34 of the I.P.C. According to the prosecution case, the informant lodged the F.I.R. alleging that on information that his sister has been killed, he went to the Sasural and from his Bhagina, he learnt that the petitioner and other co-accused have killed his sister. The learned counsel for the petitioner submitted that the alleged Bhagina who is aged about 12 years and was examined by the police and his statement has been recorded in the paragraph 17

From perusal of the order passed by A.D.J.-IV, it appears that he also found that it is the case of suicide. Considering the above facts and circumstances of the case, I direct that the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Hajipur, Vaishali in connection with Mahnar P.S.Case No.122 of 2014.
