JUSTICE MADHURESH PRASAD ORAL ORDER 17-08-2019 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under sections 302, 307 and other minor sections of the IPC. Petitioner along with co-accused Pappu Kumar is alleged to have taken away the victim. Thereafter, informant received information that victim had suffered injury as he was thrown from the motorcycle on the road by accused persons. Co-accused Pappu Kumar has been allowed bail by a coordinate bench of this court vide order dated 06.08.2019 passed in Cr. Misc. no. 32722/2019.

Considering the facts and circumstances as well as submissions of the parties, bail application is allowed. Let the petitioner be released on bail on furnishing

Patna High Court CR. MISC. No.33037 of 2019(3) dt.17-08-2019 2/2 bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate I, Bhagalpur in Sultanganj P.S. Case no. 261/2018 subject to the following conditions.

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
