The petitioner has put challenge an order dated 13.03.2020 passed by the Sub-Divisional Officer-cum-Licensing Authority, whereby the petitioner's licence to run Fair Price Shop under Bihar Targeted Public Distribution System (Control) Order, 2016, ['(Control) Order, 2016' for short] has been cancelled. It is the petitioner's case that soon after passing of the

Patna High Court CWJC No.3683 of 2021(3) dt.22-01-2022 2/2 said impugned order, the petitioner has filed an appeal before the Appellate Authority which is still pending. This is not in dispute that the petitioner has remedy of approaching the Revisional Authority in accordance with the provision under Rule 32(VI) of the said (Control) Order, 2016, in the event his appeal was not disposed of within 60 days by the Appellate Authority as stipulated under (Control) Order, 2016.

In the aforesaid background, this application is disposed of with a liberty to the petitioner to approach the Revisional Authority in accordance with the provisions under (Control) Order, 2016.
