Petitioner is not named in the first information report but it is alleged that in course of investigation, petitioner and one coaccused Raj Kumar Paswan were arrested with stolen motorcycle and admittedly, co-accused Raj Kumar Paswan has already been granted privilege of bail by the court below itself.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Raxaul at Motihari, East Champaran in Raxaul P.S. Case no. 289/2013.
