The petitioner seeks bail in a case registered under sections 363, 365/34 of the Indian Penal Code. The informant named Yogendra Manjhi and Bharo Manjhi and alleged that they kidnapped his brother son of Lalu Manjhi.

Learned counsel for the petitioner submits that the petitioner is not named in the first information report and nothing has been recovered from the possession of the petitioner. Co-accused Yogendra Manjhi has been granted anticipatory bail by this court vide order passed in Cr. Misc. No. 38076 of 2013. The name of the petitioner figured in the confessional statement of Binay Kumar from whose possession the mobile of victim was

Patna High Court Cr.Misc. No.4899 of 2015 (2) dt.04-02-2015 2/2 recovered. It appears that the name of the petitioner figured in the confessional statement of Binay Kumar so there is no involvement of the petitioner in the alleged kidnapping. The named accused Yogendra Manjhi has already been granted anticipatory bail. Considering the aforesaid facts, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of C.J.M, Sheikhpura in Barbigha P.S. Case No. 8'2012.
