The petitioner seeks bail in a case registered under sections 363, 366A/34 of the Indian Penal Code. Bhola Prasad Yadav alleged that Ashok Yadav, Arun Kumar Yadav, Manoj Kumar Yadav and Sanjiv Kumar Yadav came at the house of Badri Yadav, the petitioner and they all kidnapped his minor daughter Dropdi Kumari for the purpose of marriage. Sulochan Devi and Rubiu Devi wife and daughter of the petitioner also helped in kidnapping the daughter of the informant.
Learned counsel for the petitioner submits that the victim made her statement and disclosed that Rubi Kumari enticed her for marriage with Sanjeev Kumar and they solemnized
Patna High Court Cr.Misc. No.4913 of 2015 (2) dt.04-02-2015 2/2 marriage with Sanjeev Kumar. It is further submitted that Rubi Devi and Sanjeev Kumar have already been enlarged on bail vide order passed in Cr. Misc. No. 1217 of 2015 and Cr. Misc. No. 34006 of 2014.
On consideration of the fact that the victim herself disclosed that Rubi Devi enticed her for marriage with Sanjeev Kumar Yadav. Rubi Devi and Sanjeev Kumar Yadav have already been enlarged on bail, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Ist Additional Sessions Judge Madhubani in S.T. No. 306 of 2014 arising out of Andhramath P.S. Case No. 56 of 2013.
