JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-11-2020 Heard Mr. Kamlesh Kumar Pathak, learned counsel for the petitioner and learned APP for the State. This is an application seeking quashing of F.I.R. bearing Motihari P. S. Case No. 786 of 2015, dated 20.11.2015, instituted for the offences under Section 135 of Electricity Act, 2003.

This Court had called for a report about the stage of the case from the court below which has been received. The case is still pending submission of chargesheet / final report. It is really surprising that in a case involving

Patna High Court CR. MISC. No.38076 of 2016(4) dt.05-11-2020 2/2 Section 135 of the Electricity Act, 2003 which was registered in the year 2015, the investigation has been kept pending for five years.

This Court directs the investigating agency to conclude the same and submit an appropriate report before the court below.

If the petitioner for any reason would feel aggrieved by the report or any order passed by the Court on such report, he would have the liberty to avail of the remedies to which he is legally entitled. The petition stands disposed off accordingly. (Ashutosh Kumar, J) skm/- U T
