The petitioner has prayed for bail in connection with Kotwali P.S. Case No. 505 of 2018 registered for the offence punishable under Sections 489A, 489B, 489C, 420 and 120B of the Indian Penal Code.

As per allegation in the FIR, on secret information, the informant and other police personnel managed to catch hold of the co-accused, namely, Madhurendra Kumar with a bag full of fake currency notes. It is further submitted that on being questioned, the said accused person stated that he was only carrier of the bag, which he was asked to deliver, by the petitioner.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.35662 of 2019(3) dt.28-08-2019 2/2 that no incriminating article has been recovered from the possession of the petitioner. He is a teacher in a government school. His name has transpired on confessional statement of co-accused Madhurendra Kumar, who has been enlarged on bail vide order dated 19.06.2019 passed in Cri. Misc. No. 12475 of 2019. Petitioner has no criminal antecedent and he is in custody since 16.02.2019.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the fact that co-accused has been enlarged on bail, petitioner is in custody since 16.02.2019 and has no criminal antecedent, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in connection with Kotwali P.S. Case No. 505 of 2018 (DistrictPatna). (Partha Sarthy, J) sushma/- U T
