The petitioner seeks regular bail in a case registered under Sections 302, 201, 120B, 34 of the Indian Penal Code. The informant named four persons, namely, Dilip @ Dula Mandal, Meena Devi, Kiran Devi and Muthi Mandal and alleged that his nephew Chandan Swami had gone to the house of Muthi Mandal but did not return. On the next day, his dead body was found. The petitioner is not named in the name F.I.R. The informant suspected the hands of the four named accused in killing of his nephew.

It appears that on mere suspicion, the name of the petitioner figured in the case although there is no eye witness of the occurrence. All the four named accused have already been enlarged on bail vide order passed in Cr. Misc. No. 39101/2007,

Patna High Court Cr.Misc. No.5983 of 2015 (2) dt.12-02-2015 2/2 Cr. Misc. No. 24587/2008 & Cr. Misc. 988/2008. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sree Niranjan Singh, 2nd Addl. District and Sessions Judge, Naugachia, District - Bhagalpur in Gopalpur P.S. Case No. 56 of 2014 (G.R. No. 177/2007), corresponding to S.T. No. 1255A/2010.
