The petitioner apprehends his arrest in a case registered for the offences punishable under Section 498(A) of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is husband of the informant, it is next submitted that an application seeking divorce by mutual consent under Section 13B(1) of the Hindu Marriage Act, 1955 has been filed in the court of learned Principal Judge, Family Court, Sheikhpura.

Learned counsel for the petitioner submits that dispute between the parties has been amicably settled by way of one time settlement and the amount shall be deposited at the time of

Patna High Court CR. MISC. No.33847 of 2022(2) dt.28-11-2022 2/2 passing of final order in the aforesaid divorce case. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Pakribarawan P.S. Case No. 25 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

The learned trial court before accepting the bail bonds of the petitioner shall verify from the informant as to whether the dispute between the parties has been resolved or not and in the event, if the informant disputes the contention as raised by the learned counsel for the petitioner herein, then the present anticipatory bail order shall not be acted upon.
