JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2019 The petitioner apprehends his arrest in connection with Lalganj P.S.Case No. 351 of 2018 registered under Sections 414 of the Indian penal Code and 30(a), 32(2) and 41(i) of the Bihar Prohibiton and Excise Act, 2016.

Allegation of recovery of 377.640 litres liquor from a pick-up van and one person was arrested who disclosed the name of the petitioner as the person who fled away. Submission of learned counsel for the petitioner is that Bolero vehicle does not belong to the petitioner and he has no criminal antecedent and nothing has been recovered from his possession.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.1146 of 2019(2) dt.17-01-2019 2/2 circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act -cumAdditional District and Sessions Judge-IInd, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 351 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
