The petitioner being the elder brother of the husband of the victim is languishing in custody since 21.10.2014 in a case registered for the offences punishable under Sections 365, 498A/34 of the Indian Penal Code and 3/4 of Dowry Prohibition Act.
It is alleged that the daughter of the informant was married with Hareram Sah @ Bhodu Sah was being tortured and subsequently she has been made to disappear. Subsequently, the victim was traced and her 164 Cr.P.C. statement was recorded, which has been brought on record as Annexure-2, where she has alleged accusation of torture and demand of dowry
Patna High Court Cr.Misc. No.4643 of 2015 (02) dt.05-02-2015 2/2 against her husband but nothing has been alleged against this petitioner.
Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Hussainganj (M.H. Nagar) P.S. Case No. 176 of 2014.
